Chapter 13 - THE HEARING
Family court moved quickly because Lily was ten, the medical evidence was clear, and the audio recording left almost no room for reinterpretation.
Rebecca did not ask the judge to erase Daniel from Lily’s life.
She asked for what was safer and harder:
sole temporary decision-making authority, supervised visitation until Daniel completed parenting and medical-emergency training, and no unsupervised access for Patricia or Claire at all.
Daniel’s attorney attempted a softer version of events at first. Misjudgment. Family confusion. Delayed but eventual emergency response.
Then Rebecca’s attorney played the recording.
Not all of it.
Just enough.
Lily asking for the pen.
Patricia refusing.
Claire warning Daniel that an ambulance would “ruin everything.”
Lily whispering, “Dad, please don’t let me die.”
The judge did not need much more.
Then came the hospital footage of Patricia shoving Rebecca, Claire striking her, Daniel grabbing Rebecca’s wrist to stop her from reaching the bag.
Daniel watched the screen like a man watching his own excuses burn.
When asked directly whether he disputed the authenticity of the recording or the untouched EpiPen, he said no.
When asked why he did not act sooner, he gave the first fully honest answer of the case.
“Because I let my mother’s opinion override my daughter’s emergency. And because by the time I understood how bad it was, I was more afraid of admitting I’d failed than of what that failure had already done.”
The judge granted Rebecca’s request.
Temporary orders first.
Longer review later.
But the shape of the future had already changed.
