Chapter 13 - Building a Record He Could Not Rewrite

Maya organized the case by timeline rather than accusation.

Three weeks before Lily’s birth: Tyler began asking the obstetrician how to document postpartum instability.

Twelve days before the birth: he collected Rachel’s anxiety medication early.

Lily’s first week: Rachel’s feeding entries showed steady intake and weight gain.

The second week: Tyler took over night feedings. Lily’s weight dropped.

Four days before the driveway: he asked the pediatric clinic to list him as the primary parent because Rachel was “not retaining instructions.”

The morning of the incident: Vanessa’s package was delivered to the house, confirming she was already moving in.

The afternoon of the incident: Carol saw Tyler enter the house with the key fob while the horn sounded.

Hospital records documented Rachel’s heat injury and Lily’s dehydration.

The formula manufacturer confirmed that the yellow scoop belonged to the smaller can and would not prepare the correct concentration when used with the larger container’s instructions.

Still, Maya wanted one final connection between Tyler and the incorrect formula.

It came from an ordinary source.

The grocery store’s loyalty account was shared by Rachel and Tyler. Purchase records showed that Tyler bought the second formula brand alone during the week Lily’s weight began falling. Rachel had not been with him; she had attended a post-surgical appointment at the same time.

He purchased no replacement scoop and no ready-to-feed bottles.

The receipt did not prove every bottle he prepared was diluted.

It proved his claim that Rachel had secretly switched formula brands was false.

The county attorney’s office continued reviewing possible child-endangerment charges. DCS substantiated neglect allegations against Tyler and Vanessa but left final custody decisions to family court.

Vanessa signed a sworn statement and agreed to testify. Her lawyer began negotiating her surrender if charges were filed.

Grant provided the messages Tyler had sent him before the birth. In one, Tyler wrote, “Once Diane confirms the history, nobody can say I acted without warning.”

Grant read the sentence twice before handing it over.

“I thought he meant he was preparing to help her,” he said.

“So did I,” I answered.

The final hearing was set for a Thursday morning.

The night before, Tyler’s attorney proposed an agreement: supervised visits, parenting classes, and no finding that he intentionally manipulated Lily’s feedings.

Rachel declined.
