Chapter 9 - THE ALIBI STARTED TO COLLAPSE
The state reinvestigated the original timeline.
Technology from three years earlier did not provide perfect answers.
But old billing records still existed.
Gabriel’s phone connected to a tower serving the Vargas neighborhood shortly before 9 p.m.
At trial, the state had known the record existed.
It had not considered it significant because Gabriel had explained that he drove through Aurora earlier that afternoon.
Now the photograph changed its meaning.
More importantly, Rosa’s phone records showed a forty-three-minute gap in usage beginning at 9:18.
That meant little by itself.
Then Marcus found an old repair invoice.
Rosa’s burgundy Buick had required body work the week after Daniela died.
Damage to the passenger-side mirror.
The repair shop noted:
Customer states mirror struck garage frame late evening.
Marcus interviewed the shop owner.
He remembered nothing.
The invoice remembered for him.
Nina did not claim the car had been at Daniela’s house.
She simply added it to the timeline.
Then Elena’s school counselor contacted the child-welfare caseworker.
Elena had recently drawn the night her mother died during a therapy exercise.
Three people appeared.
Mommy.
Uncle Gabe.
Grandma.
The caseworker immediately notified the appropriate parties.
Nina refused to treat a child’s drawing as proof.
But she requested a supplemental forensic interview because Elena had introduced Rosa without being asked.
During that interview, Elena said something new.
“Grandma came after Uncle Gabe.”
“What did Grandma do?”
“She hugged him.”
“Where?”
“In the kitchen.”
“Did she see your mommy?”
Elena nodded.
“What did she do then?”
“She told me to go upstairs.”
Mateo received the summary in prison.
For several minutes he said nothing.
Nina sat opposite him.
Finally Mateo whispered, “My mother was there.”
“It appears Elena remembers her there.”
“She gave Gabriel an alibi.”
“Yes.”
“She watched me go to trial.”
“Yes.”
Mateo stood.
This time Nina let him pace.
He reached the wall, turned, and came back.
“What could possibly make a mother do that?”
Nina had no legal answer.
Outside the prison, Rosa stopped answering investigators.

And for the first time since Mateo’s conviction, the state formally notified Gabriel that he was a person of interest in the reopened investigation.
